Proving that the rule is more common than the exception, your first guess is probably correct given the obvious omission from the article.

The ultimate irony is that I came across this article while watching a Curb Your Enthusiasm episode about 'all-you-can-eat' (he didn't get arrested; in fact, he got an apology...but he wasn't abusive either and paid the bill. Duh).
I especially like (/s) the softball media approach, "A disagreement over the meaning of all-you-can-eat led to an arrest at a restaurant."
