Nothing in this example they specifically chose but more often than not, defensive driving prevents accidents. In fact, this is a case of the human driver not practicing defensive driving.
What happens if the driverless car with the right of way gets hit by a car that didn’t stop? Obviously it would be the fault of the car that didn’t stop but its an accident that is routinely avoided by human intuition every day.

Then it is the fault of the car that did not have right of way.
Obviously it would be the fault of the car that didnt stop but its an accident that is routinely avoided by human intuition every day.
That the car that did have right of way can be gracious does not mean that the fault no longer lies with the car that did not have right of way.

Point in the example is that the car DID take precautionary measures to prevent an accident. Sometimes humans just seem to insist on causing accidents anyway.
