The first congress clearly stated that NBC status is NOT dependent on location when born to one or more citizen.
that was to deal with the kids already born at the time of the adoption. it was a situation they had to deal with. 2 parents given citizenship as they’re in the country now, but had a kid in another country prior to the US formerly coming into being.
the ‘on the soil’ requirement rules out citizenship from another country. i believe it was bjclinton that lifted the dual citizenship ban for americans. as such, at the time of the founders, being born on another country’s soil would have given you a conflicting citizenship status.
either way, the dual citizen parent requirement for NBC is obvious as stated in the quote.
