What about top government officials emailing her at this email address with government communications - they had to know they were violating policy.

It's not just policy, it's the law, and she broke it. Every federal employee has an employment contract, which has a clause specifically stating that all official electric correspondence will be conducted through the government's system/servers. Failure to do so can result in fines and prison time.
