If she is blacked out drunk, it is rape.
But if the guy is blacked out drunk he can't do rape. Um, let's just say certain parts shut down when drunk.
Traditionally, it was rape if she was unconscious and unaware that she was having sex, or who she was having sex with. That I can agree with.
The standard of "it's rape if she is even mildly intoxicated" is a recent standard, and seems prone to abuse by women who are upset that one night of sex didn't get them eternal commitment from the guy.
