"Under the Obama prosecutorial discretion program, the Department of Homeland Security is mandated to end removal proceedings against an(sic) undocumented immigrants who do not have a serious criminal record.

“Prosecutorial discretion” means the government has decided that you can stay here but you do not get any immigration benefits."

Spread this far and wide. They have been using the so called prosecutorial discretion for years now but suddenly it can grant rights to illegals? I don't think so. This is proof the "prosecutorial discretion" does not grant rights coming from the very administration itself.

The house should hold a sense of congress resolution that says the SCOTUS should stay any executive order until the high court rules if Obama is violating the legislative process and constitution.

Why isn’t the SCOTUS itself making sure Obama isn’t an emperior.

What is the SCOTUS job, to sit on their hands while the Pres goes rogue?

Why isn’t the SCOTUS itself making sure Obama isn’t an emperior.

He may be able to let them stay, but I think that adding conditions, such as paying back taxes and paying a fine, amounts to changing the law, and is a step too far.....

On the verge of going bankrupt with an astounding $26.3 billion deficit, the nation’s most populous state is considering saving hundreds of millions of dollars annually by cutting monthly welfare payments to illegal immigrants.

The savings doesn’t even include the billions of dollars that California spends annually to educate, incarcerate and medically treat the 2.7 million illegal aliens (7% of the state’s population) who live in the state that has so generously offered them sanctuary for decades. It turns out that legislators are finally realizing that illegal immigrants are draining their precious Golden State.

That’s why California officials, extremely generous with tax dollars in the past, are trying to find a way to eliminate welfare payments to tens of thousands of illegal immigrants. The move, which has caused outrage among the state’s powerful open borders lobby, would save a much-needed $640 million a year.

An example of who the state cuts the monthly checks to is an unemployed 43-year-old illegal immigrant from Mexico who gets $650 a month for each of her four children and about $500 in federal food stamps and other vouchers.

Its still chump change compared to what the state spends—between $4 billion and $6 billion annually—on schools, jails and hospitals for illegal immigrants. That doesn’t even include other local government costs such as police and fire, road maintenance and other public services.

The biggest chunk—$2.3 billion—goes to educating about 300,000 illegal immigrant children at public schools throughout the state. California expects to spend around $834 million to incarcerate nearly 20,000 illegal aliens in fiscal year 2009-2010 and well over $700 million to medically treat close to 800,000 illegal immigrants.

More than half the healthcare money will go to emergency services but a substantial portion will pay for nonemergency health services such as abortions, prenatal and postpartum care and even nursing homes.

Maybe every American needs their own personal Federal prosecutor to consult with on all their everyday actions:

You call your PFP, and ask: "I'm going to walk out to the mailbox. Is that OK, or will I be prosecuted?"

"I'm going to go online now and check my email. Is that OK, or will I be prosecuted?"

And so on. Since it's quite obvious that the many, many laws are just "in their mouths", so to speak, this is what we should be doing as a matter of course.

Just thinking.

Three questions.

1. If the president, through executive action, exempts these individuals from deportation, does that change their status as illegal aliens?

2. Does the law provide that any alien in an illegal status is ineligible to work?

3. Is their a law (Possibly the RICO Statute) that allows a private citizen standing to file a lawsuit against an employer for employing an illegal alien.

If the answer to question 1 is No and the answer to question 2 and 3 is yes, that would set up an interesting situation. Since the individuals under this deferred deportation program would have to apply for inclusion their identity would be a matter of public record and if they were issued a work permit by the president, the legality of that work permit would be a fact subject to adjudication in the lawsuit. The administration would not be a party to the lawsuit but their program would be an issue. Both the alien and the employer would be at jeopardy. The program could fail for lack of participation.

Exactly. The list goes on. Food stamps, welfare, unemployment checks even though they’re not supposed to be eligible. Earned income tax credits.

I was at the hospital today and an illegal couple came to get checked in at the emergency check in. Couldn’t speak English and she was about to deliver a child. They had two infants with them. Instant citizenship and benefits for life. But don’t worry, Obama says they will pay all their taxes.
