Is Ted Cruz, born in Canada, eligible to run for president?

Can Ted Cruz run for president if he was born in Canada?

The Republican senator from Texas says he can. And just to be sure, he’s taking the extra step of renouncing the Canadian citizenship he says he didn’t even know he had.

Cruz -- full name: Rafael Edward Cruz --was born in Canada in 1970 because his father was working for the oil industry there. The senator’s recently released birth certificate shows his mother was born in Delaware and his father was born in Cuba. The Cruz family left Canada a few years later. Cruz grew up in Texas and graduated from high school there, later attending Princeton University and Harvard Law School.

Ah, so because their guy ignores the Constitution it's ok for our guy to do so?
More than saying "if they did it, we can too!", I think the argument is that 0bama's presidency has proven (as in, "it's settled law") that a candidate only needs a single, underaged parent who is a US-citizen when the candidate was born. It also proved that the provenance supporting that tenuous citizenship can be a reproduction birth-certificate that you *swear* is just like the original.

That's the new bar one needs to meet and I believe it will take a constitutional amendment to change it. We are not required to agree with it or like it. We simply have no say in the matter. There is no one at the local, county, state or federal level of competent authority who will challenge it. Those are the facts and they are unarguable. So shut your mouth, pay your taxes and quit making waves. Do you want to be labeled a terrorist?

The Constitution uses a vague term that they do not define.

Note that they were specific enough about the age of eligibility, rather than using some vague term like “mature”.

The only place in US law that the term “natural born citizen” is defined is (supposedly) in the Naturalization Act of 1790, which states:

“And the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens”

This provision is vague, either intentionally or inadvertently.

If it said “A child of citizens of the United States”, then the meaning would be clear. But it doesn’t say that. So that law, which isn’t in effect anyway, doesn’t clear up the issue. It would need to be argued in court.

I believe there are only three possibilities...

Non-citizen
Naturalized citizen
Natural Born citizen

I don’t believe there is any dispute that Cruz is a citizen. If there is any evidence that he was naturalized at any point in his life, I haven’t seen it.

By elimination, that leaves only one possibility.

The Rats will never challenge Cruz in court on this issue because it opens up Obama’s can of worms.

But I wouldn’t put it past the GOP-E to try, being the scumbags that they have proven themselves to be.

Why would that matter anyway? Like Hillary says,”What difference does it make?” OBAMA see the precedent and the Republicans and talk show hosts condomed it. Doesn’t matter where you were born now.

"The criterion is whether a person is entitled to US citizenship by virtue of the circumstances of his birth. If so, then the person is natural born."

The courts have established that "anchor babies" are American citizens even though neither parent has to be a citizen. Therefore they are "entitled to US citizenship by virtue of the circumstances of their birth"

This begs the question, then, are these anchor babies natural citizens and thus qualified to become President of the United States, even though they may be raised by parents with contrary ideology and culture to the United States? What was the intent of the Constitution framers? Did they intend that future Presidents would have at least been raised with a loyalty to and a love for America?

I believe the framers intent is clear, but their wording of the law somewhat ambiguous. We need to clear up this wording to come into focus with the intent. Because not doing so has left us with judges who can interpret the law to fit their own political leanings. And now we have a pResident (Obama) who was raised with a true hatred for everything America once stood for, and now a truly patriotic man with the potential to lead us back to sanity (Cruz) who may be deemed not eligible to become President.

Ah, me too. There are quite a few Cubans here, a Cuban family lived across the street from me when I was growing up. Wish I could remember their name. One of our favorite restaurants is Cuban, Cafe Piquette.

No his father was born in Cuba, and his mother in USA...HOWEVER Cruz was born in Canada, and I do NOT BUY THAT HE DID NOT KNOW HE WASN’T BORN IN USA...that’s absurd, because we use our birth certificate for everything.

If someone lies about anything.....be careful!
Now he would qualify DEPENDING ON THE AGE OF HIS MOTHER WHEN HE WAS BORN in CANADA. Now, since he has actually been a Canadian citizen all these years, does renouncing his Canadian citizenship now qualify him for 2016? Because I would believe he would have to become a US citizen since Canada does not have dual citizenship status.

The age of Obama’s mother was the issue, if he was born in Kenya. Go back to the threads at FR...

Look at this thread. The Democrats will never challenge Cruz's eligibility because there are more than enough Republicans who will do it for them.

Both parents were Americans it sounds like, no problem

It's not a problem if both parents were native born Americans.

he is not a natural born citizen

Natural born refers to where his parents were born, both parents, not where he was born.

**************

America encompasses much more land mass than just the USA.
Thus native born Americans are not all citizens of the USA.

Ted Cruz was an American citizen at birth. This makes him a Natural Born Citizen.

No it doesn't.

Natural born refers to his parent's birth, not his.

See if you can spot the difference.

No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States

No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President

Why did the founders mandate that only the president must be natural born but not the Congress?

I believe the reason they did that was to avoid the possibility that the elected president may have divided allegiances because of his parents’ birth location.
