Slavery was not prohibited by the Constitution, and was in recognized as an existing institution. However, it was not “set in stone” (codified) in the way those God-given rights acknowledged within the Bill of Rights were.

It was a 10th amendment issue.

Not prohibited or codified, the people and the states were free to make their own decision about how to best order their lives...
