Election-Day Registration Lawsuit: Seeking Provisional Ballots(MN)

As you know, we are committed to overturning Minnesota election law that enables ineligible individuals to vote in two ways: by not determining the eligibility of election-day registrants before counting their votes, and by accepting the statements of individuals that they are eligible even when the state has records showing they are not, such as non-citizens and felons.

We have spent considerable time with our attorneys refining the arguments that connect the precise text of the Minnesota Constitution (“[Ineligible] persons shall not be entitled or permitted to vote at any election in this state.”) to the statutes that in fact “permit” ineligible persons to vote. Currently, we are working on the final draft of our complaint and anticipate filing in Ramsey County District Court next month.

We had sought to file our complaint earlier in the year, but due to the complexity of the arguments, and our interest in presenting the best possible case to the court, we have not rushed the filing. We will have one bite at the apple and need to get it right. The Minnesota Supreme Court will likely have the final say, so it is important that we think through the entire process prior to filing.

If successful, this legal action will prevent what occurred in 2008: The U.S. Senate became filibuster-proof with the election of Al Franken by a mere 312 votes out of 2.9 million cast. I

In that race, more than 500,000 voters registered on election-day, voted, and had their eligibility verified after the election. Our data requests and review of documentation revealed that more than 48,000 of those 500,000 individuals could not be confirmed as eligible.

Our goal is simple. We will be asking the court to order the state to implement provisional ballots (as 44 other states already have) which will allow the eligibility of persons whose eligibility is in question to be determined before their ballots are counted.

We need to raise $17,500 for attorney fees, filing costs, and operational expenses—to end Minnesota’s open invitation to voter fraud and verify the eligibility of election-day registrants. Our goal is to file the complaint by June 30, 2014.

Turbo, I’m going to make a donation now. Are they targeting the suit to have provisional voting EFFECTIVE for November 2014? I would think that TIME IS OF THE ESSENCE in this matter of fraud deterrence.

yes, I believe that is their intent.

you could email them and ask. they usually reply pretty fast.

my guess is the court will delay long enough to insure the dems win uncontested.
