I was pointing out it didn't HAVE to be an accident. Our car on fire was no accident, wiring under the hood started the fire. We needed a police report for insurance purposes. And I don't know of any law that said you cannot leave the scene of a burning car. Maybe he was drunk, that is a possibility, or he could have just seen flames coming into the car, panics ran into the bridge and left the car to burn.. He just couldn't turn it into an insurance company.

The law against "leaving the scene of an accident" would apply even to your scenario. Especially because the car not only caught fire, it also smashed into the bridge.
