Looks to me that the casino was the one that screwed up by using defective cards.

Correctamundo. And it's the casino's job to catch defects and irregularities as they occur.

Trying to take action now is like a referee calling a penalty years after a game is over.

Better to just shut up and be more vigilant in the future.

And how many manned cameras did they have on a table game where someone is up a few million? I guarantee they were watching him with multiple people in real time.

Some Harvard-educated suit decided he might get himself a promotion by saving the casino a few bucks and going with a cheaper card manufacturer.
