That is my point - if they "beat" the guy as the headline says, then 2nd degree murder is appropriate. If they physically restrained him and he died from a bad heart its something else.

From the information provided:
1. The man committed no crime
2. Police charge that he was uncooperative; not a crime, and not justification for such a take-down.
3. Article says 4 cops, I count 5 in video, holding the man down. 3 pressing down on his chest and one on his neck.
4. When hes unresponsive, no one checks for a pulse or performs CPR.
If there were video of me doing this to someone who died in the process, I would be in jail right now, awaiting a trial for 2nd degree murder. Because when 5 people squeeze the air out of a man who isn't moving on the pavement, a reasonable person would conclude that lack of oxygen leads to death, whether it be heart attack, asphyxiation, etc.
