They know that if it’s a Wii controller no matter what it looks like that it will be bad for them.

I just wonder why we keep hearing “Wii controller” in the media and from the lawyer, but the possibility that the Wii controller looked like a gun is never mentioned.
If she didn’t know it was a Wii controller, she might well describe it as a BB gun.
I think it’s certainly possible that the kid had a black Wii gun in his hand.
It’s also possible that he had a standard Wii controller in his hand that was black.
Or he just had a regular Wii controller in his hand and the cop is nuts.
I think in any case, if he had something black in his hand, that will be enough to “excuse” the shooting.
It’s awful, but that’s the way it usually goes.
