FORT WORTH, Texas -- A Fort Worth police officer will not face charges for fatally shooting a 72-year-old Texas homeowner while investigating a burglary alarm at the wrong house, a Tarrant County jury decided Wednesday.
The decision to "no-bill" R.A. "Alex" Hoeppner in the death of Jerry Waller came a week after prosecutors began presenting the case to the grand jury.
Waller died May 28 after being shot multiple times by Hoeppner as the officer and a partner searched for a possible burglary suspect after being dispatched to a burglary alarm call across the street.
Family members have said Waller, suspecting a prowler was outside, grabbed his gun and had gone to investigate when he was shot.
**** "I think the community can rest assured that this was the correct decision and Hoeppner is a fine young officer," Lane added. "He has been back at work and he will continue to protect and serve the people of Fort Worth."

The next door neighbor, a city councilwoman, came to the scene immediately after the shooting and found:
“...[Becky Haskin] said she immediately went to the scene, saw officers looking for bullet casings...”
Well, at least his partner rookie officer at the time of the murder doesn't work there any more.
He got fired for filing a false police report in another case.
In this case, though, he told the truth. Scout's honor. ;-)
it wasn’t the correct decision, he should have been indicted.
I hope there are several 12 gauge slugs out there with Hoeppner’s name on them. What a menace.

The political/regulator class grand jury was only protecting its interests.
The lesson for citizens in this is to shoot first and ask questions never.
I think a lot of law and order Texans have been willing to ignore, downplay, or justify bad police behavior in their state.
Now the hydra they have been feeding is growing to large to ignore, downplay or justify any longer.
Thats why the two cops had to move the brass.

The body was where it was and blood around I’m sure. Are you saying they were inside the garage or outside?
It is all in the way the prosecutor presents the case. Often Grand Juries later find out they were lied to and would have voted the opposite if they had been given all the facts. Since GJ proceedings are secret we will never find out what exactly was presented to them.
