I've been perusing the options at healthcare.gov and ran across this interesting factoid:

That's right. Your real property won't be liened, you won't lose your driver's license and you won't go to jail.

All that needs to be done is to adjust your W-4 exemptions so that your withholding matches your tax liability as close as possible. Won't take long for the "millennials" to figure this out.

Post script- I'm not enrolling and I'm not paying the penalty. F*** 'em.

Caution: A knowledgeable FReeper pointed out the other day that although the penalty in itself will not lead to liens or seizures, if you owe the IRS other monies and the IRS takes action against those funds that the total sum including the penalty likely will be involved in the action.

Don’t forget the other loophole, Christian healthcare co-ops. I haven’t figured out which one I’m joining yet, but that option avoids both the exchanges and the IRS penalty-tax. Not saying its a perfect solution for everyone, but it is a legal alternative that might appeal to Christians with incomes too high for subsidies and too low for the new, outrageously high premiums. Like me.

I think someone should sue them and force them to go through every printed or on-line reference and change every occurrence of “fee or penalty” to “tax” before they can continue to operate. If this was perpetuated by a commercial company, I can guarantee the FTC would be so far down their throats that they would be seeing light through the butt hole.

The obamacare law is full of exemptions spelled out as “As the HHS secretary shall determine”. This goes to actual health care and penalties. This law is designed to allow the HHS secretary to make up the law as they go.

All bets are off. You ask, is my property at risk? Can they drain my bank account? Can they throw me in jail?

Potentially yes to all and more because the law purposefully left these options open and vague.

Duke, the Obamacare tax will come out of your tax withholding first, followed by your federal taxes coming second. If there is not enough withholding to cover your taxes you will be sent a bill for the taxes still owed along with fines and penalties. That is why they did not need to included fines or penalties in the law. They skirted the negative press associated, because it is already built into the system. I am not an accountant but it seems clear.
