He wasn’t committing assault, they just happened to be in the way when he was making his escape. Which is also why the driver won’t be charged.

It is much more than that. They were not just “in the way”. By being where they were, and doing what they were doing, they were part of a conspiracy to kidnap and assault. All of the hundreds of outlaw motorcycle riders in the video should be found and charged with conspiracy to attempt murder.
It was completely illegal to block the guy in and attempt to force entry to his vehicle. What people are calling a “brake check” is essentially the start of a kidnapping. At the minimum, given nothing else, it is obstruction of traffic.
I call it a kidnapping, because what else do you call it when people limit your movements to the point that you must either resist them with force, or submit to their will to stay where they want you to stay? That is kidnapping.

True enough! I think the SUV driver showed too much restraint in dealing with these bikers -- as proven by the fact that they put him in the most compromising position in the end (pulled him out of the car and had him completely at their mercy). He effectively surrendered his advantage (big vehicle) at the end, and could have been killed, along with his wife and child.
