Yes...I heard judge Napolitano discussing this yesterday on Fox, he said basically the same thing.

He said the prosecution has to prove that the defendant intended to hurt the United States.

I believe he did but I guess the judge thought otherwise.

Intent to injure was the issue. First, the had to prove injury and then they had to prove it aided the enemy, and then they had to prove intent to aid the enemy.

I wonder why they even brought the charge.
