Today, July 10th, is DAY #22 (of 5th week) State of Florida V. George Zimmerman case.
Yesterday began with a boom as defense expert witness, world renowned Dr Vincent Di Maio took to the stand to validate the forensic evidence supporting George Zimmermans version of the encounter with Trayvon Martin. However, the day ended with an even bigger THUNDERCLAP in an epic 10pm showdown as Don West took on both the State prosecutors and trial Judge Nelson after the jury was released. Ending with Judge Nelson, turning her back and walking out of court. Unreal. A great analysis of the events from yesterday is available HERE.
The late night argument, not by the State, but by Judge Nelson herself, regarding phone evidence authentication, is so weak and insufferably devoid of legal analysis it is absurd on its face. Then again, this is the same judge who said a few days ago, flippantly in open court, that evidence should be shredded (Dr. Bao notes) after use. Doh
Essentially Nelson argued that the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin (despite two security codes) because anyone could have sent them. Whiskey*Tango*Foxtrot !!
How can an email be used in a sex offender case? How can phone records be used in RICO cases? How can GPS evidence be used in Insurance Cases? How are photographs taken by perps used against them? Think about it.
You cant argue that evidence cannot be admitted because someone else might have made the actual phone call; Someone else might have physically sent the email; Someone else actually accessed the website; Someone else might have been the driver of the car; Or, someone else could possibly have been behind the viewing lens of the camera etc.
No, that argument does not mean you can arbitrarily exclude evidence. And this was the basis for her argument (watch the video).
Sure, thats an argument which can be presented to the jury by the other side, as a counter point to create doubt with the jury, but it cant be a reasonable consideration for total evidence exclusion. Then again, this is Judge Nelson who in multiple prior cases has a high historical propensity of being overruled by the 5th District Court of Appeals.
It should be noted the NAACP Annual National Convention starts in Orlando on Friday; Additionally, preparations are being made in/around Miami-Dade for a Wednesday defense wrapped up with a community/LEO preparation meeting yesterday.

Funny you would say that ‘cuz I have most often connected with your posts on these threads — either nodding my head in agreement or cheering you on or thinking “well stated!” It’s also encouraging to know that others out there have similar experiences to mine — not a big surprise here on FR! I’m always amazed when I meet people in my age group who act/sound like they are still living in hippiedom. Can’t they see what is happening!? Drives me nuts, but at least I know who they are, what they believe, and can be forewarned (so now everyone knows I’m judgmental as well as racist — ask me if I give a rat’s patootie).

Yeah, I keep thinking “If I feel this way — fearful, angry, hurting — and I’m just an observer, how much more intensely must George and his family be feeling?” I can hardly bear to imagine how his parents must feel. And I really do not want to know how many threats they have all received nor the viciousness of them. It’s evil unmasked.

I hear ya! I went from laughing hysterically and on a bit of a high after gunshot wound expert testimony yesterday afternoon to utter disgust last night to pensive — almost melancholy, if you will — today. I simply can’t shake the feeling that this trial is some sort of historical marker or milestone. Altho, I do wonder how many other trials like this are happening that we don’t even know about.

this same judge was reversed for refusing to give a self defense instruction. (another case)
she was reversed on crump in this case.
she will deny stand your ground to keep with her anti-defense stance.
she , as judge , has the lesser included option. for this judge’s career an aquital is the way to survive the next judicial election.
But I am shocked that Parks had doubts about the charge being proven. That is stunning.

and his wife Shellie! She was on the state's witness list too--just so they could keep her sequestered and out of the courtroom. The persecutors never intended to call her as a witness.
I heard him say that too. .I guess we’ll hear about that from the state in the morning. Nelson very cleverly manipulated the timing of final arguments also- letting the jury sleep on the state’s final. She was snide about it.

Thank you Viaveritasvita, that was very kind. You described the cycle perfectly from yesterday to now! I was laughing right along with you yesterday. Today, it’s just the unsettled feeling along with that story about the DOJ being involved! I think that bit on information just sealed it for me in some way, that we truly have lost so very much in the last few years. Yes, we all recognize it’s been going on far longer, but the DOJ, really? To know you can’t rely on the law to be impartial, that just hit me to the core.
My prayers will remain, as always. You stay strong too, thanks again.
I sure hope you are right. But I have become rather cynical over the past five years. And especially after watching this trial unfold.
It seems like we are watching a precursor and a preview of how things will be in this country in another decade, if the path we're on is not reversed. God help us all.
Altho I’ve read every post on every trial day thread, I’ve only been peripherally following the discussions on jury instructions. As I understand it...
We’re not absolutely sure whether Murder 2 includes lesser manslaughter charge in FL. Or if Murder 2 and manslaughter are 2 separate charges...? If M2 and manslaughter are 2 separate charges, then argument can be made to not include manslaughter in jury instructions.
Is that about right? I guess we’ll find out soon enough.

That will basically be five years hence as she was just relected unopposed in 2012 and the term expires in January of 2019.

Apparently the prosecution is asking for the inclusion of lesser chargers for the jury to consider. There will be a hearing tomorrow morning.
