They need to call in 10 ER docs as witnesses and ask each one of them if those wounds were so insignificant that they wouldn't have ordered a CT of the brain to rule out brain hemorrhage/skull fractures/etc. I'll bet all 10 would say the same thing: No, I would have ordered a CT of the brain because you can not judge a head injury only by what you see on the outside.
