FULL TITLE: 'She didn't affirmatively say no': Silence means consent according to defense in Ohio high school rape trial where passed out, drunken teenage girl was 'sexually assaulted' by multiple football players
Defense lawyers in the coming trial of two high school football players charged with raping a nearly passed-out-drunk 16-year-old girl are expected to argue on the issue of consent.
In the case that has shocked the nation, prosecutors state that the inebriated girl was taken to a number of parties by a group of drunk teenagers, supporting her to walk when she wasn't physically capable.
The prosecution claims that the group later sexually assaulted the girl while she lay unconscious.
But attorney Walter Madison, who represents one of the accused boys, argues she was drinking voluntarily and left willingly with the group of boys.
As reported by the Cleveland Trader Madison said: 'There's an abundance of evidence here that she was making decisions, cognitive choices.' 'She didn't affirmatively say no,' he stated.

I'd say he's excusing the boys quite consistently.
If I were the father of that girl (not that she’d ever be in that position in the first place, mind you), but being behind bars would be the least of their worries.
you are so very wrong. a drunk driver actually takes action that involves a deadly weapon. yes this young woman acted stupidly and was drunk out of her mind....these pigs that call themselves ‘men’ raped an unconcious victim and boasted about it....slime pure and simple

It’s clear in the story that the peeps were able to go to town on her within a few minutes, after entering the vehicle and she was dragged from party, to party, in an incapacitated state being done by many guys at each party.
It’s also clear from pictures that they were able to treat her as some limp rag doll, with no ability to participate willingly.
With all due respect, candy may be dandy, but liquor is quicker, but no booze puts a woman into incapacitation within a few minutes of ingestion unless it is laced with something.
In their defense at her being there, her parents thought she was at a sleepover with other girls. I guess they have to live with guilt and second-guessing themselves for the rest of their lives.

There’s “stupid”, then there’s “evil”. This behavior was just plain “evil.”
I did “stupid” things as a teenager, but I never intentionally meant to harm anyone like that.

No he’s not. He’s just not excusing her. You might have noticed if you have been paying attention that people who are drunk ARE held responsible criminally for their actions. For instance a person who is drunk and is in a fatal accident for instance is almost always charged with murder. Even if you passed out behind the wheel.
That doesn’t excuse the boy’s actions, but she is also responsible for her actions even if she was drunk. It’s that way through out our legal system.
