I had forgotten all about this schmuck. 38 years? Is that all you get for murder these days? I hope there’s no parole.
The exact facts are vague to me right now, but I sat on a jury at a local murder trial about 12 years ago. In Texas the jury can choose the sentence.
We gave the guy something like 40 years rather than life because with a smaller sentence such as that, he'd have to serve the full term without parole. If we gave him life, he'd have been eligible for parole in something like 15 years. In effect, at his age, we gave him a lifetime sentence.
