Did you happen to catch FNS..yesterday?
Charles Lane raised some interesting points, vis-a-vis the 7-2 ruling on the Mediscare piece...
He points out that the Voting Rights Act sec.5 and Affirmative Action is on next years dinner cart, and that the mechanism used to enforce said policies is the same one the court voted down 7-2.
As Lane put it, he sacrificed a pawn (The ACA) to put the Queen in check (the whole Great Society structure)....
Conservatives sometimes act like Jets fans.
If they found a bag full of 20’s they’d complain that they weren’t 50’s.
The problem I have with the reporting on this,is there is no mention of the rest of the pending lawsuits.
The simple fact is, if you want to speak in terms of defending the Constitution, giving the Left a campaign license to trash the court like they did over Bush v. Gore, does not accomplish that end.
Striking the bill down because the mandated coverage violates the First Amendment is a far better method towards that end.
(And...lastly..remind me again what the ratio of Senate seats being defended is...Every Dem senator running Voted to Tax the middle class.)
I have to wonder if this ruling will change the minds of those trashing Romney on this board? Will it give them the “excuse” they need to vote bammy out?
I did see FNS. I broke my habit of skipping the propoganda shows this week.
We had freaking Anthony Kennedy chomping at the bit to overturn this thing and we still couldn’t get it done. All thanks to Mr. Souter II.
And now it sounds like Souter II has lost Kennedy...permanently. The rift in that relationship will make things difficult until AMK retires, which I’m now willing to bet will be next year, if Romney is elected. And while I’m not the biggest AMK fan, I fear we’ll lose a libertarian-conservative (anti-Kelo, Citizens United, Heller, anti ACA, etc.) with a statist one.
But the HHS mandate is a regulation, not a legislative requirement. So a court could strike the mandate down and would have no reason to strike down the law.
I still can’t see the rationale. What makes you think they will rule correctly on all the pending lawsuits and how far into the future will they stretch/postpone them? I believe they should have gotten rid of this hot mess when they had the chance and let the chips fall where they may. Bird in the hand and all that.
