Wickard v. Filburn has been implicitly overturned or at least greatly undermined.

did people really expect any different?....when the leftists needed a ruling, they got one from a "conservative" supreme court justice Sandra Day O'Connor...

its like they're all bought and paid for...

and now, this "conservative" court will only get more leftist especially if bamey gets selected again...

Tell me about Germany. Is it more free than you hear America becoming? Obviously it is very tech savvy. Can you own a firearm? Is emigration from the US possible?

Based on history, this opinion’s effects are not fully appreciated yet. Looking at the Justices in the majority and those in minority is all we need to know about this.

Here’s some good news: The San Francisco Giants knocked the LA Dodgers out of the NL West first place last night.

Roberts has brought it front and center that a fine is a tax and nothing else.

HE AGREED WITH ELENA KAGAN!!!!

Good article:

The Supreme Court didn’t carry the water this time ..... “Republicans have punted a number of issues to the Supreme Court asking the Court to save us from ourselves.”

I agree with your analysis. Justice Roberts did his job by looking at the constitutionality, not by being an activist for the side he might have personally favored.

So Scalia, Thomas, Kennedy, and Alito were being activists?

The heat is being turned up faster isn’t it?

We need to get this over with as soon as possible.

Death by a thousand cuts is pure agony without purpose.

Better victory or death with honor in a just fight than suffering and disappearing whimpering into the night.

I’m wondering about all those waivers. Can HHS/Sebelius “waive” a tax?

Agreed.

Up until now I would vote only down ticket in November. Now, if Romney is the nominee, I will vote against Obama as well as down ticket.

I wonder that if it is indeed a tax, is it a constitutional tax. The constitution says:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

According to an old article in NYT, the tax will be: In 2016, when the penalty is fully phased in, it will be $695 for an individual (up to $2,085 per family) or 2.5 percent of household income, whichever is greater. The penalty will increase annually based on the cost of living.

If the tax exceeds household income it can no longer be described as a tax on income. For some individuals the tax may be greater than their income because it is the greater of a percentage or a minimum amount. The minimum amount can exceed someone’s income. If that is true then this tax as written may not pass constitutional muster unless it is amended to remove the flat amount.

If it needs to be amended, then some future congress has to vote on it and I cannot see it getting amended without significant changes.

As Rush said today..

“TEA only gets stronger the longer it stays in hot water”.

And I AM STEEPING!!!!!!!!!!!!!

I believe the rational Americans will see to it that this monster is gone from office in November, if not before. THink we were heard in 2009 and 2010? You haven’t seen anything like the shitstorm coming their way.

Thank goodness my TV is in the repair shop, I would have shot it when that was announced.

Governor Romney has already said his first order of business as President will be to repeal Obamacare.

Honest question: do you seriously believe him?

“If Obamacare survives repeal efforts, then in 2014, someone will pay the ‘tax’ and then challenge its Constitutionality.”

SCOTUS will then cite today’s decision as precedent and deem it constitutional. Unless a few justices retire, Romney is president, and Congress is sufficiently Republican to tip the court in our favor. But since when can Republicans reliably nominate, I won’t say conservative justices but at least justices whose decisions aren’t diametrically opposed to the wishes of the party that nominated them?

Which is to say nothing of all future mandates, Republican and Democrat, called “taxes,” that Congress sees fit to pass. Nice try.

The Federal Government hereby Commands you to buy Broccoli every Tuesday, Gym Memberships at Gold’s Gym, Enterically Coated Baby Aspirin, wine, Fish Oil, a Chevy Volt, and Solar Panels for your roof.

All these things are good for you, as your Superiors have decided, and they get to decide how to spend every last dime you earn. The Supremes said so today.

You are now owned, lock stock and barrel, by the government.

They can direct 100% of your earnings as they see fit.

You’re a slave this morning.

A government mandate was NOT approved today.

Now it is far worse. Thew government can coerce you to do anything as long as they call it a tax. What can't the government force us to do?
