Recently on internet radio show Center Stage the topic was DOES THE CASTLE DOCTRINE JUSTIFY THE MURDER OF MARK HOWARD. The family of Mark Howard were guests and came armed with the 911 tape, autopsy report, incident report and crime scene photos. They say the evidence proves their brother was murdered and WCPD is involved in a cover-up.

There MIGHT be something wrong with what the shooter did, however there is nothing wrong with the castle doctrine, every state should have one.

I have my own Castle doctrine. You come in my house uninvited and I’m gonna blow your ass away.

Well the doctrine may be fine i don’t have a problem with it either but your right the method in which mark was shot is wrong he was shot riding away on a bicycle evidence shows from what i understand he was found across the street in a neighbors yard with a bullet through both lungs and his heart but he supposedly shot in the shooters yard and fell got up while being shot clean through and rode 60 feet to the street and then fell in the subsequent yard !

60 foot shot clean through?

the shooter didn’t even get arrested or detained and it seems a lot of evidence was covered up by both law enforcement and the local news

I am a bit biased in this case as i am marriage related to this mans sister i knew mark and his family just wants to see justice do its job they have evidence to the contrary of the facts in this case and the martin / zimmerman thing just rubs salt in an open wound if you get my meaning ....

@Family of victim outraged over lack of charges in W. Columbia shooting(SC) February 17, 2011
"It's uncivilized," said uncle Rod Peck. "And it's sending a wrong message to people that they can just shoot any trespasser on their yard. Worst case scenario, maybe if one of the neighbor children came over in the middle of the night, it could have been one of the neighbor children. And we believe that this is wrongful death. That this is criminal, what this man did."

Would you have shot him for trying to steal from you or break into your truck?
Homeowner Richard Williams confronting a man he'd seen breaking into his truck shortly after 3:00am.
You wouldn't know it was at 3:00 AM (dark-thirty as we say).

You people didn't even know he was back in town!
His uncle says Howard's family was surprised he was in south Carolina, and had no idea why.

The evidence shows no finger prints on the truck and mark was riding away from the property when shot the story has changed several times over the last few months from the shooter his wife and the media as well and there are bullet holes through 2 different neighbors houses there was no blood in the driveway where he was supposedly shot and got back on the bike and no evidence of any tampering on a shed that was nearby ....

It’s possible in my Opinion mark made a wrong turn into the driveway the outside light came on and the dog started barking and the homeowner came out blazing thats the reason for the shots through 2 different houses before hitting mark they guy just started firing

Question .... would you shoot someone that was riding away from you on the street would you just walk out your door and start shooting in the dark ?

I have not had a chance yet to view all the evidence and i’m not a lawyer by any stretch of imagination but this is case is so alike this zimmerman fiasco shot in the dark at 3 am seems to me a wrong headed decision to shoot someone off a bike for just riding down or out of your driveway ...

"If they collect evidence down the road that says something different, we can always revisit the decision,"s aid Riddle. "But as it stands today, the only evidence that's there indicates that it's self-defense. I have zero evidence to disprove self-defense, which is what I have to do according to the law."

Zero Evidence ?

So riding away on a bicycle is a call for self defense ? there is something clearly wrong with parts of this law mark was not armed and in order to be riding away he would justifiably have his back turned ......away is away !

As i said before i have not one problem with the law itself BUT parts of the law should be changed because when innocent people get killed with their back turned and no weapon the law is most certainly written badly .....Just suppose it was a neighbors child say a 17 year old sleep walking {it happens believe me} what would happen to the shooter nothing? or would the neighborhood be screaming for justice ? i think the latter

I have to apologize for my passion for these laws to be written in a manner that allows you to defend your home and property but still afford a innocent person the right to live without fear of be killed by someone who wantonly and brazenly brandishes a firearm with no regard to life ...

This is the second time in my life that some law as written has taken a family member from my life some of you may recall that my uncle was killed by an illegal Mexican alien some years ago in a head on collision and then escaped from the hospital never to be seen again ... in this case border laws not being followed or adhered to and it was found out later that the same illegal hit a woman head on around Chicago and severely injured her before he hit my uncle

Sorry for the loss of your friend/relative, but being 'out and about' and messing with somebody's vehicle at 3:00 AM in the morning kind of indicates to me he was up to no good to begin with.
If you have a link to the police report I'll read it.

As it stands now you're not exactly the best source for unbiased information as you're too close to the issue, IMO.

BTW, as to this...and no weapon...
You can effectively kill somebody with a 4 D cell Mag Lite (or similar). Blunt force trauma.
You can kill somebody with a screwdriver. Plunged into heart or brain.
You can kill somebody with your bare hands! Strangulation or a strike to certain areas of the body.
So what do you mean by "no weapon"? Unless you're a vegetable on life support everybody has weapons at their disposal.

Hands, elbows, knees and feet.

A children's song? Self defense for the young!

Ya can't kill someone riding away from them on a bicycle can you ?

And yes i am biased i said that earlier but am doing my best to be objective

I Will see all the evidence sometime this week i think.... his sister has crime scene photos and all so i can make a better assessment then

Law enforcement has reopened the case because there are to many conflicting reports through the media and through law enforcement itself from what i am told the stories have changed several times from the shooter and his wife first he broke into a garage then it was the truck then supposedly he was just running away after the dog started barking and the automatic lights came on so your guess is as good as anyone's what happened but it all sounds suspicious to me

Nope, especially when you know they're armed with a firearm and you have to make a 'quick get away' because they've already shot at you a couple of times when you started walking towards them in a threatening manner.

Well it would seem more appropriate, to me anyway, to wait until you had seen the evidence, or at least had it at hand, before posting this thread.
You're convicting without evidence.
