Is flashing your headlights illegal or a free speech issue?

There is no Florida law that prohibits light-flashing, said Oviedo attorney J. Marcus Jones. He claims officers are simply twisting a law that was designed to prohibit drivers from adding after-market emergency lights to their vehicles.

When officers write those tickets, he said, they violate a driver's constitutional right to free speech. If motorists want to flash their lights to warn about a speed trap ahead, they are free to do so, according to his suit.

I have no problem with speed limits, provided that the people putting up the signs comply with the laws and regulations for signage. Those laws and regulations mandate speed limits be set to the safest possible speed. And that speed is the 85th percentile speed of free flowing traffic on that road, rounded up to the next 5mph increment.

When a speed limit within a speed zone is posted, it should be within 5 mph of the 85th-percentile speed of free-flowing traffic.
There are federal laws and regulations which requires states to follow this manual for all traffic control devices (signs. lane markings, traffic signals) in order to receive federal funding. Failure to follow these guidelines can (should) result in states losing their federal funding for highways.

Any speed limit sign posted for a lower speed (less than the 85th percentile speed):

This is proven engineering and science. Not some "feel good" mumbo jumbo.

The reality is that almost no jurisdictions bother to follow MUTCD regulations for speed limit signs, and speed traps are a major source of revenue for many cities and counties. Some localities get over 70% of their revenue from traffic fines.

In Texas you can get a jury trial for a traffic offense, (or you could in the past) I was called to be on one of those juries years ago. We threw the book at the guy because he was a reckless idiot just trying to get off with a bogus excuse.

Folks are not going to be able to spell, type, drive or do diddily squat if they are dead and in the ground because some idiot speeders ran them off the road. Yall got to quit changing the subject and obey the laws. The laws are not there to make a buck. They are there to keep people safe and alive.

You all should feel very ashamed that a wonderful man, a police officer, has to sit and waste his time on the side of the road and watch for speeders - how pathetic that this is the wretched example our children have.

In traffic court you are guilty unless you can prove yourself innocent, and your word doesn’t count, The cops does.

You accuse us of having an IQ potentially lower than 10, yet you yourself post to yourself? You’re definitely not advancing your cause. Perhaps you should take time off the computer and go make up some practice ballots and practice checking off the Obama box, after all, you wouldn’t want to make this kind of mistake come election day.

I saw a trap setup here once that was right in the transition zone from an 80km/h zone down to 50km/h. I was so disgusted by the obvious attempts at revenue enhancing, that I parked on the side of the road about 1km up, and flashed at all the traffic coming for a good 45 mins. (I was bored at the time, and had time to kill waiting for a client to show up). The cops could see me, and the reason it ended at 45 mins is because they packed up and left. That put a large smile on my rabble rousing face.

I mean, people out here routinely go 10 miles over the speed limit, and you are calling them morons who should be fined $10,000 and have their cars destroyed.

It would be interesting to see what parts of the country do it more than others. You have never seen it, I see it all the time, and not just for speed traps. I wonder if it would be analagous to the the areas where two strangers do a “finger wave” to each other when they pass going opposite directions on two lane roads.
