Judge in Casey Anthony Civil Case Recuses Himself

For unknown reasons, the judge in the civil lawsuit against Casey Anthony recused himself from the case on Friday.

Judge Jose Rodriguez made the announcement shortly after the 8 a.m. hearing began, reports CBS affiliate WKMG.

Zenaida Gonzalez, who shares the same name as a fictitious babysitter whom Casey Anthony claimed kidnapped her daughter Caylee in 2008, is suing Anthony for defamation.

The move came after Anthony's attorney called for a sidebar, where attorneys from both sides talked with the judge for about 15 minutes.

Gonzalez's attorney, John Morgan, said he did not request the recusal, WKMG reports.

Morgan was expected to argue Friday that Anthony should be deposed before she is released from jail Sunday. He filed the motion Wednesday requiring Anthony attend a deposition either on July 19 or before Sunday's scheduled release from the Orange County Jail.

Morgan is concerned that Anthony will not show up for a scheduled deposition next Tuesday and he wants a judge to force her to appear, reports the station.

A timetable for a decision is not known.

Not only that, but when she came forward and demanded that they tell the public she was NOT the Zanaida they were talking about, they all refused to cooperate.

There was already some court case where they refused to acknowlege that she was not the one.

I do think that the founder of Aqua-Search has a good claim to get refunded for his time and equipment used in searching for the little girl.

I agree. That man spent a fortune looking for little Caylee.

Yes, I think it was something like $100,000.

I felt so bad for the guy. He apologized to everyone from God to those he did not help because of the misuse of Aqua-Search.

We really need to overturn the supreme court’s 1895 decision that “jurors need not be informed” of their rights.

If the jurors themselves had been asking their own questions and deciding for themselves what was or wasn’t admissible evidence, things might have turned out very differently.

I am wondering if the change in judges had to do with Casey’s attys filing an appeal on the convicted charges so she won’t have to be deposed? If this gave them enough time to file that appeal so this will happen in the hearing.

The manslaughter charge WAS available. The jury ignored it, found her not guilty of that either.

“Jose Baez had divorced and failed to keep up with $200 child support payments for his only child.

He had declared bankruptcy. Liens were filed against him for unpaid loans.

His finances were in such disarray that he was not allowed to practice law – a decision upheld by the Florida Supreme Court.

According to the Orlando Sentinel, the court said his behavior showed “a total lack of respect for the rights of others and a total lack of respect for the legal system, which is absolutely inconsistent with the character and fitness qualities required of those seeking to be afforded the highest position of trust and confidence recognized by our system of law.”

Shameful of them, all of them. I know there’s some sympathy for Casey’s parents here, but I haven’t a lot of it, personally.

Wrong. Zeneida’s case has nothing to do if Casey was found guilty or not. It has do with an innocent person’s life being destroyed because of Casey’s lies.

They said on tv last night that she has to appeal so that she can take the 5th in the Gonzalez case.

But didn't Casey just invent a name out of thin air? Seems to me it's pretty hard to defame a non-existent person. That this woman shared the same name is unfortunate, but I think it would have to be proved that Casey intentionally defamed her. I think defamation is harder to prove than that. Otherwise everybody named Scott Peterson has a case, too.

No. This person was defamed due to Casey Anthony’s lie. Zeneida appears to be the person on the apartment sign in sheet that Casey got her name from. Casey was heard telling her parents on one of the jailhouse videos a description of Zeneida which also completely false.
