At the hearing the defense tried to assert that the four false statements in counts 4,5,6 & 7 shoud be considered only one false statement to avoid double jeopardy. Defense said they were uttered in one continous conversation.
State objected, giving the judge legal precedent as to why this was not true. Statements were made at least at three seperate time frames over a 12 hour period.
Judge agreed with State. Ruled that Casey has to serve four one year terms—consecutively—for the false statements, and that jury had spoken loud and clear on the issue.
Judge and attorneys have to do the math, as Casey will be credited for time served against the four year sentence.
Then went over appeal process—30 days to appeal his verdict.
Most likely she will be free before August 1st.
