If there is precedent that such utterances should be considered a continuous act, then they have every right to make the motion.
Most folks get really angry when they see how the court system works. But its been working this way for a couple of hundred years.

Heck, let's just give her a couple million for wrongful imprisonment while we're at it. Then she could start a campaign fund and be Obama's next VP candidate. Nowadays, that's a ticket that couldn't lose. A socialist, and a late, late late, term abortion advocate.
