Very important: Aston now telling the jury they don't have to agree that it is premeditated murder. As long as they go for felony murder (death occurred as a consequence of and while Casey was committing or attempting to commit aggravated child abuse), and agreed that Casey killed her, it will still be a 1st degree murder conviction.
Under this scenario I can't imagine why Casey doesn't get a first degree conviction.
