A question for legal eagles on the judge’s instructions so far: How is a toddler capable of provocation?
I can't answer that but childish ACTING people provoke me to thinking about it.... ;^)
Whether a toddler could be capable is irrelevant. The judge needs to mention it or be subject to having the case appealed because he failed to "properly" instruct the jury regarding the law.
