As jumpy as I tend to get in my home you (gestapo styled police) best make sure you have your insurance paid up as I’m just as apt to open fire as I am not. I may die but you won’t like your odds either. I’d rather be judged by 12 than carried by 6.

“When the couple went back inside their apartment, the husband told police they were not needed and blocked the doorway so they could not enter.”

Classic behavior in a domestic violence case.

“It’s not surprising that they would say there’s no right to beat the hell out of the officer,” Bodensteiner said. “(The court is saying) we would rather opt on the side of saying if the police act wrongfully in entering your house your remedy is under law, to bring a civil action against the officer.”

How are you going to bring civil action if the bastards have killed you?

Justice Steven David is the only Daniels appointee on the court. He’s been there 8 months.

Decision available here: Barnes vs. Indiana (Acrobat PDF)

"We hold that there is no right to reasonably resist unlawful entry by police officers."

Amazing!

Well THAT just reset the rules of engagement, didn’t it? Draw your own conclusions. Do what must be done.

As the economy slips away so does our rights, there always seems to be more and more fear that as the money dries up for enforcement-the cure is to make that enforcement as easy to affect as possible.

This country goes on,just remember that laws can change, that the wrong steps can be redressed. That we can keep moving this land into a right direction.

I knew the 4th Amendment was on life support in this country, but hell, I didn’t know Indiana decided to fire a Gatling gun for 20 minutes into its now bullet ridden body.

Just wow.

Stuff like this is why I am no longer comfortable flying the flag. It means little.

Why not just force the homeowner to give beds, shelter and food to the police and military?

Seriously, how far of a step is that from this?

I have not read all of the Freeper comments to this article (and it has been posted on Free Republic 3 times), however, I suspect there will be some from the law enforcement community who will defend this outrage.

Unless the good, honest police officers rebel, and publicly refuse this obvious violation of the 4th Amendment, we will head down the path to our Police State in very short order.

Unfortunately, I don't envision the law enforcement community doing anything, except taking advantage of this 3-2 "decision" by a group in black robes who should be thrown into prison themselves for treason against the Constitution of the United States.

"We believe ... a right to resist an unlawful police entry into a home is against public policy and is incompatible with modern Fourth Amendment jurisprudence,"

Living. Breathing. Document. As the statists would have you interpret it.

I think that most of you are purposefully mis-interpreting this case and the ruling.

I believe that the ruling was that the homeowner had no right to assault the police officer, who was performing his duty. You can’t just run in the house and shut the door when a police officer shows up to investigate a complaint. Now, if you are already inside when the officer arrives, it may be a different story. The courts are not just going to rule it mutual combat when an officer is trying to investigate a complaint.

I think that we are missing a lot of the details, here.

There is no “modern” 4th ammendment. There is always the Bill of Rights. They can word it otherwise, but it will always be there. Stand up People.

Who were the judges that ruled in favor of this violation?
