I’m a little confused by the variations of “assault” from state to state. THere’s assault, attempted assault, assault&battery, battery, 1st 2nd and 3rd degree assault...

There’s no consistency, or doesn’t seem to be. Is hitting with a rock first degree assault? Is spitting on someone 3rd degree assault? What the heck is battery if it’s not assault? Can you batter someone without assaulting them?

I’m confused also. In Fl, assault is threatening someone. Battery is touching someone. These two can become aggravated if a weapon is used.

Pretty soon only lawyers will be allowed to fight and even they must have a judge as referee.
