I am not a lawyer, nor do I play one on TV, however I’m smart enough to be able to read the U.S. Code and the case law behind it.
18 U.S.C. Section 2242. should apply in this case, as in all other cases on this matter. It deals with Sexual abuse, and it reads It reads:
“Whoever ... knowingly
(1) causes another person to engage in a sexual act by threatening or placing that other person in fear..; or
(2) engages in a sexual act with another person if that other person is
(A) incapable of appraising the nature of the conduct; or
(B) physically incapable of declining participation in, or communicating unwillingness to engage in, that sexual act;
or attempts to do so, shall be fined under this title and imprisoned for any term of years or for life.”
In case law the question of wether or not any specific touch can be construed as “sexual” in nature has usually been left to context, which might mitigate against it at an airport screening ... except for in cases where sexual organs are handled. In such cases, the touch is deemed to always be sexual, with abuse therefore being determined by the person whose organs are being handled; hence, Title 18 applies.
I suggest demanding to see a police officer and pressing criminal charges under Title 18 U.S.C Section 2242. If the cop won’t respond, get yourself a lawyer and press charges that way. We MUST get a Grand Jury to determine if the law might apply sufficiently so that warrants for arrest can be issued and a criminal proceeding to go forward. Arrest several hundred TSA agents and this molestation will stop,
Thus far I’ve flow several times the past month and have not had my genitalia touched. I have been waiting for that day to press charges under Title 18, but haven’t been able to because the TSA hasn’t been compliant enough to select me for molestation. I guess I’m too ugly.
yes! Demand on the spot from federal TSA immediately, if you have been molested, to have the -—local-—police summoned, and make an official charge then and there and file it with the police.
