THOMASTON, Ga. (AP) - An Upson County couple is suing a grocery store chain in federal court, claiming that the husband found a used tampon in his bowl of cereal. According to the complaint, Thomas and Lynn Roddenberry said they bought a box of Chocolate Chip Crunch cereal from the Save-A-Lot store in Thomaston in October 2008. A day after buying the cereal, Thomas Roddenberry said he discovered the tampon in his bowl after taking a bite of the cereal.

I find their claim highly suspicious, looking for some quick settlement money.

Was the chain also the manufacturer? If it was a national brand and the box was sealed the store shouldn't be held liable. IF the story is true.

Its probably possible a ticked off cereal worker was able to toss it into the production line.

This happened two years ago. The cereal is trackable by lot to the time and place of production. The evidence, such as it is, contains DNA. If true, that worker would have been identified already.

I guess the theory of the lawsuit is that grocery stores have an obligation to open and screen prepackaged food items.

I have heard the phrases, “who peed in his cereal this morning?” or “Why did you have to come here and pee in the cereal?” “Why is there a tampon in my cereal?” is definitely a new one.
