Montana has long been tolerant of drivers who drink.
Some small town bars still offer cocktails in a to-go cup. Repeat DUI offenders are shuttled in and out of the system before they have a chance to sober up.

No one should be in favor of “safety checks”.
Also, wouldn’t it be safer to let someone drink a beer on the way home rather than let them drink it before they got in the car? Seems their impairment would be less in the first scenario.
I don’t think so. How do you assure that the idiot who is about to drink and drive doesn’t drink one before taking off?

I haven't seen the statistics, but I would bet most drunk driving fatalities involve only the vehicle of the drunk driver. It is not unusual to drive an hour or more and not see another car going in either direction.
Enforcement tends to be most vigorous around major cities such as Billings and Great Falls and generally lax in the rural areas. Ditto for speed limit enforcement.

For the sake of argument a driver either finishes one off before driving or drinks one on the drive home.
If they have already had several they are going to be more impaired, but that wasn’t the hypothetical. And if they are impaired past the legal limit, there is a law in place for that.
As a Canadian, I was surprised many years ago when I encountered the “Go Cup” in a vacation to the deep South. It was so blatant, there were tables by the door stacked with plastic cups. I don’t know if this behaviour still occurs in the South, I haven’t been in a long time. Besides, I’m no longer a club-hopping drunkard, that particular avenue of “pleasure” having been permanently barricaded.
The fact that theres a law is no comfort to the next of kin of the victims of the impaired drivers. What gives them the right to be so stupid?

It is perfectly legal to drive at .07 (although some states do have a separate offense starting at .05). Is it safer to have someone at .07 for the duration of a trip, or to arrive at .07 at the same time they are arriving home possibly never even getting to .07 during the drive?
Not saying that either is wise, but the option to have one on the way home seems like it would result in a less impaired driver than the guy who has one at a nearby watering hole before he heads home from work.
You asked how we would know if someone was impaired by having had 2 drinks, I said there is a law for people over the legal limit. An open container, I don’t think means someone is per se impaired. On a short trip, there is no way a beer could start to effect someone.
Its not so blatant anymore since the State banned smoking in bars. Now there is a sign by the red plastic cups that says "no glass on the patio".

drinking that 1 beer on the way home so that they aren’t fully absorbed of the alcohol.
Well that does bring up another scenario that has happened to me. What if a designated driver despite his best efforts still has friends drinking in his car? Should we punish him for doing a good deed?
I drove across a lot of northern Montana in 1993 (U.S. highway 2). There were white crosses wherever someone had died in an accident. I must have seen hundreds of crosses—they seemed especially numerous just outside Indian reservations. I suspect most of the fatalities were caused by drunk drivers.
