Until the Supreme Court says it is unconstitutional it is constitutional. The Supreme Court has the last say on matters regarding the Constitution. Just because some lawyer does not agree with it does not make it unconstitutional. We may not like it or agree with it but our beliefs make no difference to constitutionality.
