(CBS) Updated: 6:30 PM, June 1: In an email to MSNBC's Norah O'Donnell, Elizabeth Edwards stated that she is not trying to deny John Edwards custody of their two younger children in the event of her death.
Elizabeth Edwards reportedly doesn't want her estranged husband, former presidential hopeful John Edwards, to raise their kids if she loses her battle with cancer.
But can a mother legally keep an estranged spouse from getting custody in that kind of situation?
The New York Daily News reported that Elizabeth is looking into whether the couple's 28-year-old daughter, Cate, can assume legal guardianship over their two youngest children, Jack and Emma. The newspaper reports that, if she dies from the breast cancer she's fighting, she doesn't want them raised by John.
Elizabeth's sister told the paper: "There a lot of family members who are willing and able" to take care of 10-year-old Jack and Emma, now 12.
Since Elizabeth announced her cancer had returned, John has admitted having an affair with his former campaign videographer, Rielle Hunter. He's also acknowledged he is the father of Hunter's now-2-year-old daughter.

I don’t think your question was outrageous or cruel.
Some people are just sensitive about talking about cancer and life expectancy. Don’t take it personally.
It’s obvious you were asking about the general prognosis for her type of cancer, not promoting her death.
So sorry about your bil. Just curious, do you know if it was lung cancer? Small cell or large cell? My mom died from small cell at 18 months post diagnosis. The usual prognosis is 1 year.
I’m not sure what type. The worst area was in his lungs, and he had surgery to remove a lot of lung tissue.
Though he lived almost 5 years after the first surgery, he lost a lot of weight, and tired easily. For his last year, he weighed under 100 pounds. The VA doctors were able to prolong his life, but he was very limited in his physical activity.
It made me realize that those of us who are healthy are very fortunate.
I understand being ticked off by him, but it's not all about her.
The bitterness is going to act as a catalyst for the cancer.
I’m no John Edwards fan by ANY means; but I hear that Elizabeth was your typical nagging, alpha female; loving the limelight but now playing the victim. Personally, I’m tired of all these biomoms assuming that just because the guy is a jerk to them that they will be a jerk to the children. Leave the children out of it. It’s that type of thinking that goes hand in hand with parental alienation which is what she is doing. Divorce the guy, take all his money then take his children away from him. Classic.
