Mark Levin, has indicated he would challenge this legally if used.
As the HA article points out, Ralph Nader and Public Citizen filed a challenge to self-executing rules in 2005 when the Republicans used this maneuver. The case was dismissed in the DC court.
I hope Levin gets further if he takes it up.
