The Constitution (Article 2, Section 2) gives the President the power to grant reprieves and pardons for offences against the United States except in cases of impeachment. This power is exercised by Presidential proclamation.
In 1795 President George Washington issued an amnesty to all participants in the Whiskey Rebellion.
In 1946 President Harry S. Truman issued an amnesty covering 1,500 draft resisters in World War II. Six years later he granted amnesty to 9,000 individuals who had deserted from the military during the Korean War.
What prevents Obama from simply granting amnesty to all illegal aliens?
I don’t think that anything necessarily prevents him from doing this. But he does not possess the power by proclamation to make them citizens. Which is the goal of the amnesty of which you speak.
If they were not “illegal”, what would be their status as employees?
President Obama will not try to grant amnesty to the illegal immigrants.
1) The democrats will float a bill for amnesty
2)the republicans and many blue dog democrats will catch holy hell from their constituents for even THINKING about voting for any amnesty bill
3) Bill is defeated
4) During the 2010 congressional race, the media will label those who voted against the bill as anti-Latino(racist),ACORN will make sure many of the illegals can vote thru fraud and the dems gain additional seats.
Amnesty talk is all about consolidating power.
Of course that doesn't stop them from voting and collecting welfare.
They are illegal aliens. And them money word here is aliens. The president does not have the power to grant citizenship by proclamation. Just ask Obama’s Aunt Zituni. If he could make her a citizen he would have done so already.
These aliens have entered the country illegally. The most he could do is pardon them for illegal entry. Thus paving the way for a green card. The rest of it would be on the green card holder to fulfill the requirements for citizenship.
I believe that Congress can make an individual a citizen but it must go through both the House and Senate and be signed by the president like any other law.
In think in the case of “reprieves and pardons,” they have to be charged with a crime or convicted of something first, ie, the Scooter Libby situation.
TO answer your question they would be resident aliens. a.k.a. green card holders.
Although this is usually the way it is done under Department of Justice policies, the president does have the power to grant a preemptive pardon. Ford's pardon of Nixon is one example.
Yes, of course. And that is done with the assumption a crime has been committed and that there will be legal consequences. I guess part of my point is that, pardoning illegals would involved admitting that they are criminals who have broken the law, and that does not fit in with the mindset that they haven’t done anything wrong.
What would them prevent them from applying for citizenship?
Sorry for my ignorance. Appreciate everyone’s replies. If they have a green card, wouldn’t that eliminate all the employer problems? Border problems? In other words, wouldn’t that simple act resolve the illegal alien issue? Would they still need a visa?
They would have to apply as a resident alien like anyone else.
They still cannot work without a green card, which will also issue them a Socialist Stupidity number.
But without being directly identifiable they are able to function off the official radar that you and I are under scrutiny of every day.
