Criminal Possession of a Weapon 3rd Degree is a firearms charge. I suspect the “victim” or possible felon posessed something more than a brick. Apparently the intruder is lucky he used the brick.
In NY Under the law, a person can use physical force to defend their property but it is up to the courts to decide as to whether or not too much force was used.

Back in the 1920s my mother was a police reporter. She told the story of one case she covered where an establishment had a robbery. There was a very hefty charwoman on her knees scrubbing the floor when the robber entered. When the robber turned his back to her she got up and threw a brick which brained him.
My mother asked her where she got the brick.
Oh, she said. Ah always carries a brick in mah boosom!
