They can try, but Kennedy was a pretty scummy character, not well liked outside of Taxachussets and the beltway.
Unfortunately, the beltway does the voting.
Even if they try to use that argument one can always bring up the fact that under Obamacare the average Joe with brain cancer would have died alot sooner than Kennedy did, if they got diagnosed at all.
