Someone who has been 'naturalized' cannot possibly be native born. Besides it's not true anyway that a person born of an American Citizen parent, is automatically a citizen, regardless of where born. If born outside the US, to one alien and one citizen, the citizen parent must meet certain residency requirements, which were 10 years total and 5 after the 14th birthday, which Stanly Ann did not meet, in August of 1961, or at any earlier time. If OTOH, she was not married, she only need to have been a citizen and resided in the US for one year. However either way, that's "naturalized at birht", under statute law passed under Congress power to define a uniform rule of naturalization, therefore, he would not under those conditions be eligible to the office of President, again if born overseas. Only if born in Hawaii, and illegitimate and with no father claimed on the BC, could he then claim "natural born" status.
The Constitution does not say native born; it says natural born. That definition has been the subject of dispute since 1790. There is no dispute about what “native” means.
What dispute? Congress realized they'd exceeded powers enumerated to them under the Constitution, and so "natural born citizen" could not be extended by them to citizens born overseas, and so they removed it in 1795.
It's all quite orderly and in accord with the original understanding of John Jay.
Excellent point.
So, if you have Barack H. Obama, Sr. then you have Barack H. Obama, Jr. If the Prez had a son and wanted to name him the same, then that child would be Barack H. Obama III, correct?
Sometimes it’s worth a laugh tho...
What have you been up to?? ;)
Well, one indication of why this little glitch was exposed relates to the specious comment you so casually tossed out, that being born in Hawaii would make him a natural born citizen ... and you know the issue is far from settled since his claimed father was a British subject. Are you one of those who believes anchor babies born of illegals but upon AMerican soil are also natural born citizens?
Well I’ve been wondering who trumandogz is, and now you’ve nailed it. Trumandogz is Chevy Chase! Of course that would also mean that Non-Sequitur is Ben Stein, and WOSG is John Belushi ...
Have you had a chance to look thoroughly at Apuzzo’s case in IIRC New Jersey? That one is the sleeper suit which has a really strong chance.
I got a copy when Charles put it together.
I believe his mother was a US Citizen at the time of his birth.
If indeed he was born in Hawaii (unproven), it would make him a natural born citizen.
Based upon what law or what provision in the Constitution? There are none dealing with natural born citizenship outside of the language specific to Presidential eligibility.
That language in the Constitution was understood at the time it was written and ratified, to have specific meaning, and Supreme Court decisions right through at least to Perkins v. Elg in the twentieth century, are within the original understanding, that a natural born citizen is born in the United States, of two citizen parents.
If you're citing a law regarding citizenship status, it is only pertinent to naturalization per the power enumerated to Congress under the Constitution.
