I don't think they can. Due to the actions of the governor of Hawaii (R) in "assuring the privacy" of Opossum's BC, he won't get a chance.

I believe Obama tried to get access to it surreptitiously while he was in Hawaii back in December wine'ing and dining influential people, and his courting of Gov Lingle.

I don't think he was successful.
