He didn't defy an order -- he questioned the order pending further information, in a respectful and legal manner in a civilian court room.
And before he had a chance to "defy an order", the DoD canxed his deployment orders. Then, they fired him in retaliation.

Article 90 (Assaulting or willfully disobeying superior commissioned officer)?
