Legislation cannot change the Constitution.

Two points:

  1. The Constitution doesn't define "natural born". So, Congress can simply rewrite the law to cure any problem a Kenyan birth would present.
  2. At this point in time, enforcement of eligibility is up to Congress. A majority of the House and two thirds of the Senate. Not gonna happen absent a tremendous uproar across the land.

No... it is up to the Secretaries of State of all the States to issue eligibility.

You can’t get on the ballot of any state until its SOS declares you eligible..which until now has not been a problem.

You mean, create law...not rewrite law.

Those laws could then be challenged in court as well.

This of course presumes that the country remains asleep after all this rises to the top. It further presumes that there isn't a shake up in Congress, like Pelosi for example who certified Barry as being legit. I think if the libs tride to write such law on the spot would awaken the sleeping giant in "us." The tea parties would be made to look like...well...a child's tea party.

The Congress cannot define Constiututional terms, that would be equivalent to amendmending the Constitution, and so woudl require an amendment, or a judicial finding of what the term meant at the time the Constitution was writeen. One side does not get to unilaterally change a contract.

2. At this point in time, enforcement of eligibility is up to Congress. A majority of the House and two thirds of the Senate. Not gonna happen absent a tremendous uproar across the land.

Only applies to removing a President. If not eligible, BHO is not President.

No they can’t “simply rewrite” the U. S. Constitution. They must amend it.

I respectfully disagree with some of what you say.
Congress can not simply rewrite any laws pertaining to this. they would need a signature by ... Obama. Can’t happen. Plus they can’t just add to the constitution without a lot of attention. ratification is serious and it can’t just happen so easy.
Enforcement of the eligibility is passed when they did confirmation hearings which really hurts Obama. Mccaion was only eligible after the hearing because both his parents were US citizens. According to Obama his father was not.

The judge would have the power to order his removal, not congress. They are out of the loop now after they agreed to accept him.
This is a challenge to that very issue.
