As a 24 veteran, with much of that time spent as a Navy JAG, I concur. This is a foolish avenue to explore, and I don't believe any lawyer with even a working knowledge of the UCMJ would pursue such an action. I don't know who this Orly person is, but his legal advice is suspect, at best. At worst, I see some malpractice issues.
It's a her. And if her legal advice is suspect it could be because she got her law degree online at William Howard Taft University.
Foolish is the word. But perhaps he's in on the setup for this, as that's all it is. Orly Taitz is an activist that has been cluttering various courts with Obama birth cert issues for months. It's his pet project.
This case, just like the birth cert issue, and now this Major's career... is going nowhere.
The troops need better counsel than Orly but until he provides his BC he is an usurper. Our soldiers are sworn to uphold the Constitution.
The Major is seeking a temporary restraining order from a federal judge.
The Major states in his brief that he is “ready, willing, and able” to deploy.
The Major states that his single intent is to “clarify” how he can identify an illegal order (viz. Obama’s eligibility) without violating his legal orders.
The lawyer is a woman, I think a Russian immigrant.
