An Omaha man has been cited for animal cruelty after allegedly beating a dog because it wouldn't stop barking. The rat terrier mix had injuries severe enough that it had to be euthanized.
The dog, named Pompoo, was tethered on the back porch of an apartment at 75th and Howard Streets on Monday morning.
Pompoo's owner, Catalina Snyder, says 57-year-old Kevin Cleavenger knocked on her door, but she didn't answer because she was scared of Cleavenger. Then she said she heard yelping and saw Cleavenger slamming her dog repeatedly to the ground before leaving.
Catalina's husband Michael couldn't believe the man would do such a thing. "He took my dog by the leash and slammed him on the ground four times, as hard as he could do it, and then when he wasn't moving no more he went back up to his place."
Catalina Snyder says, "I didn't say anything because I was scared and then after that the dog is laying there and I thought he was dead."
Mark Langan at the Nebraska Humane Society said the dog's injuries were severe. Pompoo had internal bleeding and was euthanized. "This was a very vicious attack, there was absolutely no reason for it whatsoever."
Langan said there are better ways to handle a barking dog, like calling the Humane Society at 444-7800 or Omaha Police after hours.
"It still never ceases to amaze me how mean and stupid people can be and this is a perfect example right here, there's absolutely no excuse for what this person did," said Langan.
The Nebraska Humane Society cited the suspect for misdemeanor animal cruelty, but a felony is still possible.
Langan says, "In order to prove felony animal cruelty, you have to show one of four things: repeated beatings, mutilation, torture or abandonment resulting in serious injury, illness or death to the animal."
"Repeated" beating could be the key for a felony in this case, plus intentional and knowing harm must be shown.
Since the state enacted the felony law in 2003, there have been felony animal cruelty cases in the metro. In 2004, the first case, Jariel Pittman was sentenced to at least 16 months in jail. In 2005, Anthony Schepis was sentenced to one to two years.
Now Langan says, it's time to evaluate Pompoo's death. "The county attorney's office has to look at it in a black and white fashion - can they prove the facts in court - and I trust their opinion as to the decisions they make."
The Douglas County Attorney's Office will be looking over this case Thursday to decide whether it's misdemeanor or a felony. A felony charge is a maximum of five years and/or a $10,000 fine. A misdemeanor is up to six months in jail and a $500 fine.

This is a case where a pit-bull attack on the man would be warranted and praised IMO.

In this story (above link), the dog owner acknowledges that the neighbor had previously complained about the barking to her as well as the landlord.
There is no bark worse to the ears than that of a little terrier.
What he did was wrong, but the owners were wrong to arrogantly ignore the aggravation their dog’s barking was causing to others.

Exactly.....I’m dealing with MORON neighbors who have yapper dogs going day and night. While this guy went too far I can sympathize with his frustration. In my experience these ‘pet’ owners are mentally ill. They take no responsibility to correct their dog’s behaviour and take a hostile attitude towards anyone not enjoying the non-stop barking.
Get over yourself.
The woman says she didn't answer the door because she was scared of the mean man. She did not control her dog. That was her responsibility. While I disagree with his specific technique for dealing with the dog, complaining and arguing and asking and begging will not get any results, and only the death or incapacitation of the dog will end the barking. That is a logical conclusion, even on an emotional level. When mice get in your house, they get killed; gophers get killed, coyotes and wolves get killed, wild cats get killed.
It's only a dog, anyway. If the woman cared, she wouldn't tie it up outside.

I wish there were more happy dog stories being posted. If that jerk had hurt one of my dogs he would have been taken care of just like he slammed that dog. You know it is really easy to dial 911 & make a complaint. There is no reason to go beat up a dog. Police are paid to deal with issues like this.
Once the teen boy answered and sounded a bit snotty about it. I think his parents straightened him out because he wasn't the next time. Finally they got a special collar that sprays a citrus odor whenever the dog barks and they cured him.
I could tell they weren't happy with me at first but I persisted politely, but firmly, and they fixed the problem. Now we have no problems with each other.
It's the wrong kind of dog for a house dog. Some kind of cattle dog. Previously they had a greyhound which they kept outside in the little kennel year 'round. Not good in a freezing Rocky Mountain winter. They're nice people but a little dumb I think.

As you know I have a pack of dogs. If they bark in my fenced in yard for more then 5 min I am out there getting them inside. I don’t want to annoy anyone. However I don’t know all my neighbors anymore & would not take it up with the neighbor behind me. They are strange as it is & Joe has had it out with them over a few things. If their dog was barking for a long time I would feel safer calling the police. My town has a 20 min barking law.
I have a feeling that he never complained politely about the matter. He comes off as a bully and a thug, otherwise why would she have been scared for her life and refused to come outside and speak w/ him?!
The guy was a bully and took it out on the dog, IMO.

Hmm... probably a good thing they didn’t have a newborn baby then ehh? I don’t know about you, but a crying baby, you know when they really get worked-up is pretty hard on the ears. I’m not saying taking action would be ok, but you know the parents not shutting the kid up is really quite devastating to others. I mean some noise makes people want to kill, I’ve seen it a thousand times before.

If the neighbor had issue he should have at the very least complained to police if it was so devastating and aggravating. Built a profile and let the police deal with it.

I didn't want to call the sheriff's office on my neighbor because that usually makes a permanent rift. I came close to going that route though. The dog barked incessantly for over a year before I started calling them. Then it took about six months of calling before they got serious about doing something.

Still, I’d like to know why the owner of the barking dog tied it up outside an apartment building. That’s just asking for trouble... not only from irate neighbors, but from your friendly neighborhood Pit Bull as well..
I have no idea why people get dogs and then just banish them to live a lonely life by itself outside. What’s the point? If you want a pet to just occasionally look at now and then, get a snake.

People who keep barking dogs tend to be disturbed — sometimes deeply disturbed. When you begin pushing the buttons of that kind of person, you never know what will happen.
A 21-year-old Houston man was arrested for taking seven people hostage and torturing them with red-hot forks, electrical cords and scalding grease in a dispute over his dogs. In Marin County, just down the road from me, a man was arrested after he attempted to hire a neighborhood teenager to burn down the home of one of the people who complained about his dog. I had similar neighbors in the county of Sonoma. They responded to telephone complaints about their dogs by immediately stepping outside and letting loose a burst of gunfire.
Nut jobs. There are a lot of ‘em out there. People who abuse animals are very strongly inclined toward violent behavior, and folks get killed in disputes over dogs every day. Those are good things to keep in mind as you approach the owner of a barking dog.
Having seen my share of canine-owning nut jobs, I can tell you there are a few key phrases you need to listen for. In my experience, if any of the following occur it likely means that you are dealing with a seriously disturbed person:
the owner denies that the dog is barking and insists that it must be your imagination or some other dog you are hearing.
they admit the dog is barking but say that it doesn’t really bother you — that you only pretend it bothers you because you are out to get them.
they insist that barking doesn’t bother normal people and it only bothers you because you are somehow flawed or defective.
they tell you they know you are working in concert with others or that they know you are trying to turn others against them. (This perception, by the way, is greatly exacerbated by the Multiple Household laws that mandate that the victim must call on the other neighbors and recruit them to join in the legal action.)
they receive complaints about their vicious dog behaving in a menacing fashion and respond by insisting that the dog “just wants to play” or “just wants some loving,” or otherwise refuse to acknowledge the dog’s threatening behavior.
