Jury says rancher didn't violate migrants' rights

TUCSON, Ariz. — A jury in Tucson has found that a southern Arizona rancher didn't violate the civil rights of a group of illegal immigrants who claimed he detained them at gunpoint in 2004. The federal jury also found Roger Barnett wasn't liable on claims of battery and false imprisonment. But the jury did find him liable Tuesday on four claims of assault and four claims of infliction of emotional distress. The jurors ordered Barnett to pay nearly $78,000 in damages. The bulk of that is punitive.

Read the article in post 57. I don’t think he had a reasonable fear for his life as the only armed person with a big attack dog in the confrontation. This guy had been asking for legal trouble for quite some time. Thank goodness the jury could see past the B.S. portions of the lawsuit and focused on just the law. I think this case is a win-win in that the goofy civil right crap of the illegals was thrown out, but the RKBA was not undermined by disregarding the law on the appropriate use of force.

Beats the heck out of $32 million...

I agree it is still a travesty; and, I understand the family can’t stand too many wins like this one. However, with increasing public awareness, more and more light being shined on the inability of current enforcement processes to stem or halt the influx of illegals, we are beginning to take the steps to right this listing ship of state.

Has anyone started a collection kitty to help these folks defray legal and judgement costs?

I noticed in an article today in the WA Times, the rancher’s lawyer said he WOULD appeal. Since the jury threw out the ‘civil rights’ claims, the rancher will NOT be liable for attorney’s fees. Of the $78,000 awarded, $60,000 was for punitive damages.
