Wrong. U.S. Constitution Article I Section 5. is specific that each house has sole authority of whom will be admitted and etc. That means the courts as well as the executive have not authority on this matter.

Now that's out of the way. I believe the appointment by the Governor has a check and balance system that was not completed by an attorney general. I may be wrong. But I am not sure he has to be legally seated as I understand it.
