BuzzA woman's 80-year-old grandfather fatally shot her estranged husband after he tried to take their two children from the grandparents' house, Conroe police said Saturday. Brice Wade Boudreaux, 32, died Friday evening at the home on Silver Creek Drive in Conroe, police said in a statement. The investigation was ongoing Saturday, and it was not immediately clear whether the grandfather would face charges. He was questioned by police and released. According to police, Boudreaux's estranged wife and children have been living with her grandparents for about five months.

I don’t disagree with that! I tend to think that anything where you wind up shot dead is a bad idea.

Sounds like a "clean shoot" to me...

Not so fast. The case for Aggravated Kidnapping is way weak.

§ 20.04. AGGRAVATED KIDNAPPING.
(a) A person commits an offense if he intentionally or knowingly abducts another person with the intent to:
(1) hold him for ransom or reward;
(2) use him as a shield or hostage;
(3) facilitate the commission of a felony or the flight after the attempt or commission of a felony;
(4) inflict bodily injury on him or violate or abuse him sexually;
(5) terrorize him or a third person; or
(6) interfere with the performance of any governmental or political function.
(b) A person commits an offense if the person intentionally or knowingly abducts another person and uses or exhibits a deadly weapon during the commission of the offense.
(c) Except as provided by Subsection (d), an offense under this section is a felony of the first degree.
(d) At the punishment stage of a trial, the defendant may raise the issue as to whether he voluntarily released the victim in a safe place. If the defendant proves the issue in the affirmative by a preponderance of the evidence, the offense is a felony of the second degree.

I’ve heard from a relative of the deceased who says that many of us have jumped the gun as to his character and motives. The young man was of good character and was a great Father who was trying to get a divorce that his wife wouldn’t give him. He just wanted to see his kids.
I believe this could come down to a tragic instance of both parties acting hastily, each convinced of the rightousness of their own cause. Terribly sad.

Maybe you could get an answer to a question I’ve been wondering about. Was Mr. Boudreaux there for a scheduled visitation? Did he show up unannounced? Just what were the circumstances behind his attempt to see his children?

I’m Brice’s cousin. Brice WAS NOT a violent person, in fact I don’t think he had a mean bone in his body. It might be hard for people to believe that about him when you guys don’t know him, but I know because he’s my family and everyone that does know him knows that he’s the sweetest teddy bear loveable guy you could meet. And he was going to court about the kids but Stacia never showed up and then refused for him to see the kids on Christmas. We are all devestated that this happened. And for what? because she was refusing to let him see his babies that he loved beyond words! I will ALWAYS ALWAYS believe that she is the reason my cousin was killed. Selfish gain gets you nowhere’s. I’m with Tiffany “I hope it hurts when she breaths too”!

I’m Brice’s cousin, your right there is a lot more to it. It’s Stacia’s fault that my cousin’s not here anymore. I seen what Tiffany put on her page, but I am going to be at the same funeral she MIGHT be at. If she knows what best for her she won’t go. I hope she’s reading this because she did this!!! They all had a chance to call 911 but they did’nt. I hope out wonder judicial system comes through this time. I would like to thank all the people that have said nice things about my cousin, it’s really hard reading the bad stuff people are saying because that’s not who he was and if they could have met him they could see for theirselves. He wasnt on drugs or drinking, he just wanted his kids. If she would have went to court the first 4 or 5 times she put off the court date everything would still be. I guess we can’t change the past. We all love you and will miss you very much!
